Sudha Hospital & Medical Research  Centre  Pvt. Ltd. (“we”, “us”, “our”, “Sudha Hospital”) is the owner and operator of  the domain www.sudhahospitalkota.com and all associated web pages (“Website”) and the services provided therein (“Services”). This document outlines the terms and conditions (“Terms”) under which you (“you”, “user”) may access and use the Website and Services. These Terms, along with our Privacy Policy, Cancellation & Refund Policy, and other policies referenced here in,constitute a legally binding agreement (“Agreement”) between you and Sudha Hospital.

1. Legal Compliance and Governing Law

This Agreement is governed by Indian law and is published in accordance with the following legal statutes:

• The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
• The Information Technology (Intermediaries Guidelines) Rules,2011

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kota, Rajasthan.

2. Eligibility and Access

You must be at least 18 years of age and capable of entering into a legally binding agreement under Indian law to use the Services.If you are accessing the Website on behalf of a minor,you represent that you are their parent or legal guardian. Access to the Website and Services is granted at the sole discretion of Sudha Hospital and may be revoked at any time with out notice if any term is violated.

3. Data Collection and Privacy

We collect personal and sensitive information to provide Services, such as appointment scheduling,diagnostics,and consultations.For complete details,refer to our Privacy Policy.

• Data includes name,age,contact details,health history,and payment information.
• Information may be shared with third-party service providers and payment processors strictly for fulfilling Services.
• We use reasonable security measures including HTTPS, data encryption and access.
• You must not share your account credentials.Sudha Hospital is not responsible for unauthorized access resulting from user negligence.

4. Appointment Booking and Consultation

• Appointment availability is subject to confirmation by our operations team.
• Scheduled times are indicative and may vary due to emergencies or delays.
• We reserve the right to cancel or reschedule appointments at our discretion.In such cases,full refunds will be processed if payment has been made.
• Users must arrive at least 30 minutes prior to the appointment.

5. Online Payments

Sudha Hospital provides secure payment options through third-party gateway providers,including Razor pay.By making a payment, you agree to the terms of the respective payment provider.

Refunds & Cancellation

• Cancellation by Patient (more than 12hours before the scheduled appointment): A full refund of the consultation fee will be provided. Please note that the convenience fee is non refundable. The patient must contact Sudha Hospital administration to initiate the refund process.Refunds will only be processed upon confirmation from the hospital office.
• Cancellation by Patient (less than 12 hours before the appointment or in case of a no-show): No refund will be issued for the consultation or the convenience fee.
• Cancellation by Hospital (e.g.,due to doctor unavailability / emergency condition / technical error etc  ): A full refund,includeing the consultation and convenience fees,will be issued to the patient only same payment mode.
• Failed Payments: If a payment fails and the amount is debited from the user’s account but not received by Sudha Hospital, the responsibility for refunding the amount lies solely with the bank or payment gateway. Sudha Hospital shall not be held liable for delays or non-refunds in such cases.

Note: Refunds will be credited to the original mode of payment with in 7 to 14 Working days, Subject to the processing timelines of the respective bank or payment gateway.

6. Medical Disclaimer

All information provided on the Website or through the Services is intended for general informational purposes only. It does not substitute medical advice, diagnosis, or treatment. In case of a medical emergency, please call an ambulance or visit the nearest hospital immediately. Do not reply on Website communications for urgent or critical medical needs.

7. User Obligations

By using the Services,you agree to:

• Provide accurate and complete information.
• Use the Services only for lawful purposes.
• Refrain from uploading unlawful or abusive content.
• Not interfere with Website security,servers,or networks.

Sudha Hospital reserves the right to terminate access or take legal action if a user is found to be in violation of these obligations.

• Breach of these Terms.
• Misuse of the Services.
• Violation of any law or third-party rights.

11. Termination of Access

We reserve the right to terminate or suspend user access at our discretion, especially in cases involving:

• Fraudulent activity
• Abuse of Services
• Legal violations

Upon termination, all data may be retained as per applicable legal obligations.

12. Reviews, Feedback, and User-Generated Content

Users submitting are views or feedback must:

• Not post defamatory, offensive, or false content.
• Comply with intellectual property laws.
